Agreement to Terms

Adsero Fire Protection Engineering provides professional fire protection engineering services including:

All services are provided in accordance with Australian Standards and the Building Code of Australia by qualified RPEQ-registered professional engineers.

Professional Standards

Our engineers are registered with the Board of Professional Engineers of Queensland (BPEQ) and adhere to the BPEQ Code of Practice. All work is performed in accordance with professional engineering standards and relevant regulations.

Engagement and Scope

Services are provided based on written agreements that define the scope, deliverables, and terms of engagement. Any changes to the agreed scope must be documented in writing and may affect project timelines and fees.

Client Responsibilities

Clients are responsible for:

• Providing accurate and complete project information
• Timely review and approval of deliverables
• Providing access to sites and relevant documentation
• Informing us of any changes to project requirements or constraints
• Payment of fees in accordance with agreed terms

Fees and Payment

Fees are agreed upon prior to commencement of services and may be based on fixed price, hourly rates, or other arrangements as specified in the engagement agreement. Payment terms will be outlined in project proposals and invoices.

Late payments may incur interest charges. We reserve the right to suspend services for overdue accounts.

Intellectual Property

All designs, calculations, reports, and documentation prepared by Adsero remain our intellectual property until full payment is received. Upon full payment, clients receive a licence to use deliverables for the specific project purpose.

Clients may not reproduce, modify, or distribute our work without written permission. Use of our deliverables for purposes other than the original project requires our consent.

Website Content Ownership

All text, images, and content on this website (excluding the Adsero logo) are the property of Icedreamery Property Trust T/A Platform21. This includes but is not limited to:

• Website copy and written content
• Photography and images
• Design elements and layouts
• Graphics and visual assets

The Adsero Fire Protection Engineering logo remains the intellectual property of Adsero Fire Protection Engineering. Unauthorised reproduction or use of any website content is prohibited without written permission from the respective copyright holder.

Limitation of Liability

While we strive to provide accurate and reliable services, our liability is limited to the scope of services specifically engaged. We are not liable for:

• Decisions or actions taken by others based on our advice
• Defects in construction or installation by others
• Changes made to our designs without our review and approval
• Matters outside the agreed scope of services
• Indirect or consequential losses

Our total liability for any claim is limited to the fees paid for the specific services giving rise to the claim, except where prohibited by law.

Professional Indemnity Insurance

We maintain appropriate professional indemnity insurance in accordance with industry standards and regulatory requirements.

Confidentiality

We treat client information as confidential and will not disclose it to third parties except:

• With client consent
• As required by law
• To consultants or contractors assisting with service delivery (under confidentiality obligations)
• To professional indemnity insurers if required

Termination

Either party may terminate an engagement with written notice. Upon termination:

• Clients remain liable for fees for work completed
• We will provide deliverables for completed work phases upon payment
• Confidentiality obligations continue

Warranties and Disclaimers

We warrant that services will be performed with reasonable skill and care by qualified professionals. However:

• We make no warranty that designs will receive regulatory approval (as this depends on authority interpretation)
• We are not responsible for site conditions not disclosed or discoverable through agreed investigation
• Historical advice or designs may require updating to reflect current standards and regulations

Dispute Resolution

If a dispute arises, parties agree to first attempt resolution through good faith discussion. If this fails, disputes may be referred to mediation before pursuing legal action.

Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the Queensland courts.

Website Use

The information on our website is provided for general information purposes only. While we strive for accuracy, we make no representations or warranties about the completeness, accuracy, or reliability of information on the site.

Unauthorised use of our website may give rise to a claim for damages and/or be a criminal offence.

Changes to Terms
